Hi, everyone! Thank you so much for joining me today. I’m divorce lawyer AJ Grossman with Leap Frog Divorce. I’m also a Florida Supreme Court Certified Family Mediator and dispute resolution specialist.

This is video number seven in my Myths of Divorce series. Today, we’re discussing a belief some people have about divorce: that because they were married, their spouse must support them financially for the rest of their life.

That simply isn’t true. Florida law does not automatically require one spouse to support the other for life after divorce.

How Does Alimony Work in Florida?

Florida law considers several factors when determining whether alimony, also known as spousal support, is appropriate.

One important factor is the length of the marriage. For example, a spouse seeking support after two years of marriage may be in a very different situation from someone seeking support after 20, 25, or 30 years of marriage. Courts recognize that the circumstances of each marriage are different.

Another important consideration is each spouse’s financial situation and ability to earn a living.

If a spouse can support themselves and earn enough income to meet their living expenses, a court may determine that alimony is not appropriate. However, the decision depends on the circumstances of the case and the applicable legal requirements.

Does Your Spouse Have to Support You for the Rest of Your Life?

The belief that someone is automatically entitled to lifelong financial support simply because they were married is a myth.

This applies regardless of whether the marriage involves a same-sex couple or a different-sex couple. The court considers the relevant circumstances rather than automatically requiring one spouse to support the other indefinitely.

Every divorce is different, and whether alimony is appropriate depends on the specific facts of the case.
