Can you get full custody of your children in Florida?

Well, it depends.

Florida’s default for custody is what’s called shared parental responsibility, which means you and the other parent will share and cooperate and coordinate regarding the major decisions for your child or children.

When you want full custody of your child, basically what you’re telling the court is that shared custody would be harmful to your children—that there’s something wrong with the other parent that has resulted or will immediately result in harm to your child.

And so that’s pretty significant. That’s pretty substantial.

The state of Florida and our courts want to make sure, at all possible, that both parents remain in the children’s lives, that each parent gets to share in the joys and the responsibilities of raising a child.

So, unless you’ve got something really significant, chances are a court is going to order that you and the other parent share parental responsibility or custody of your child.
